Conditions of Trade

BIO LIVING TERMS Of TRADE POLICY 

 

1. Privacy Policy

1.1. Access to Consumer Credit Information for a Commercial Credit Application (Section 18k(1)(b) Privacy Act 1988). As part of its normal credit procedures, I consent to BioLiving  International Pty Ltd obtaining a credit report about me.
1.2. Personal information will be disclosed to a credit reporting agency (Section 29 of the Credit Reporting Code of Conduct) to obtain a consumer credit report for the purpose of assessing commercial credit application.
1.3. Exchanging information with other Credit Providers (Section 18N(1)(b) Privacy Act 1988) I agree to BioLiving International Pty Ltd obtaining personal information about me from other credit providers, whose names I may have provided to BioLiving Pty Ltd or that may be named in a credit report, for the purpose of assessing my application for commercial credit.

 

2. Account Terms

2.1. The Supplier may in its absolute discretion refuse the Customer credit facilities or suspend or discontinue the supply of goods or to varythe Customer’s credit limit at any time without any obligation to provide to the Customer or Customer’s Guarantors prior notice or a reason for such action
2.2. All accounts must be paid for in full by the Customer thirty (30) days from the date of invoice
2.3. Until the Goods have been paid for in full the Customer shall store the goods in a manner which clearly indicates the ownership of Bio Living International Pty Ltd and shall hold the goods as bailee for Bio Living International Pty Ltd
2.4. All orders over $300 are delivered FREE to anywhere in Australia (excluding WA, TAS or NTH QLD which automatically carry a $15-45 charge).
2.5. If the customer fails to make full payment by the due date, interest will be charged at a rate which is 2 percent higher than the rate for the time being fixed by section 2 of the Penalties Interest Rates Act 1983 (Victoria) calculated on a daily balances on monies owed by the customer to the Supplier both before and (as a separate and independent obligation) after any judgement until paid in full.
2.6. The Customer will pay Bio Living International Pty Ltd for any and all of the Suppliers expenses including but not limited to legal costs on an indemnity basis with any other collection costs incurred in connection to these terms and conditions. Such costs duties and other expenses as well as interest pursuant to section 1.3 may be recovered as liquidated debt.

 

3. Credit Limit

3.1. If the Customer has an account with Bio Living International Pty Ltd, the Customer will have a credit limit in place
3.2. Bio Living International Pty Ltd may at any time in its discretion refuse to extend credit to the Customer and that its approval of thisapplication does not require Bio Living International Pty Ltd to extend to the Customer any particular amount of credit.
3.3. If the Customer exceeds their credit limit, Bio Living International Pty Ltd may require the customer to either part pay or pay all accounts in full before any further orders are accepted or any existing orders are fulfilled.

 

4. Cancellation or Suspension

4.1. Bio Living International Pty Ltd is not obliged to supply Goods in relation to any order and may cancel or suspend to the trading account of the Customer at any time if:
        a. The Customer breaches any of these Terms of Trade
        b. The Customer provides any false or misleading information to Bio Living International Pty Ltd
        c. The Customer commences to be wound up, placed in liquidation or under administration
        d. The Company has formed the opinion (in its absolute discretion) that the Applicant no longer meets the financial conditions or commitment expected from its customers

 

5. Delivery

5.1. All deliveries of goods will be made via the Company’s nominated freight company (unless prior arrangements have been made with Bio Living International Pty Ltd).

5.2. Bio Living dispatch orders daily (Monday – Friday)

5.3. Delivery can take up to 2 working days. Customers from Tasmania, WA & regional areas please allow 3 – 7 working days for delivery. (Delays can occur due to extreme circumstances e.g. fires, floods, holiday periods & etc.)

5.4. Acceptance of the goods is acceptance of these terms and conditions. No other conditions as implied by the customer’s order or otherwise will be considered unless accepted in writing by Bio Living International Pty Ltd

 

6. Freight Cost

  • Minimum orders of $200 will get prompt delivery with an additional freight charge of $15-$45 (incl. GST) dependent on delivery location.
  • Orders under $200 will not be processed, however our team can assist with adding on to your minimum order.
  • Orders of $300 or more will receive free delivery (excluding: WA, TAS or NTH QLD – which carries an automatic $20 minimum freight charge).

Please note: Freight charges are subject to change - customers will be notified.

 

7. Returns/Defects

Returns and claims

(a) Proof of Purchase Required: All returns must be accompanied by valid proof of purchase, including:

  • Customer store name.
  • Invoice number the goods were sent on.
  • Item Number
  • Item Description
  • Quantity
  • Reason for request
  • Photos if applicable
  • Contact Details for follow-ups.

(b) Timeframe for Claims:

  • Any claims for credit, including but not limited to non-delivery or defective goods, must be submitted in writing within 48 hours of receiving the goods. Claims made after this period will not be accepted, and the goods will be deemed accepted by the customer.
  • If a product is visibly damaged at the time of delivery, do not sign off on the delivery docket. Instead, note the damage on the docket (e.g., "Damaged item(s)") and notify our office within 48 hours.

 

8. Conditions for Replacement or Credit

(a) Damaged Products:

  • Obvious damage must be reported at delivery as described above.
  • For claims regarding damaged or short-dated stock, photos must be provided as proof to support your claim.

(b) Incorrect Products:

  • Products delivered incorrectly must be returned in their original packaging and condition.
  • Provide photos of the product sent in error.
  • Bio Living will bear the cost of shipping for replacement items or the return of incorrect products.

(c) Exceptions:

  • Returns or credits will not be accepted in the following cases:
    • Change of mind or no longer wanting the product.
    • Financial inability to purchase the product.
    • Choosing the wrong product.
    • Choosing the wrong quantity.
    • Customer-caused damage to the product.
    • Items not returned to original packaging/condition.

(d) Credit Usage Policy

Any credits issued by Bio Living cannot be refunded as cash. Credits must be used to offset future purchases and are valid only for transactions with Bio Living. Credits are non-transferable and cannot be exchanged for any other form of payment.

(e) How to Submit a Claim

To ensure we process your claim promptly and effectively, follow these steps:

1. Email Your Claim

    • Send all claims to info@bioliving.com.au.

2. Include Essential Details:

    • A clear and concise description of the issue.
    • Proof of purchase, including the invoice number.
    • Relevant supporting documentation, such as:
  • Photos of damaged, short-dated or incorrect stock.
  • A copy of the signed delivery docket, if applicable.

3. Specify Your Request:

    • Indicate whether you are requesting a replacement, credit, or other resolution.

4. Timeline Adherence:

    • Ensure your claim is submitted within 48 hours of receiving the goods. Late claims will not be accepted.

5. Packaging and Returns:

    • Retain all original packaging for damaged or incorrect products, as these may need to be returned for verification.
    • If a return is required, Bio Living will provide shipping instructions and cover the cost of returning the items.

While all efforts have been made to ensure that all product information including ingredient listings are accurate, up to date and complete for products on the Bio Living website, suppliers may change formulations on short notice. Please check ingredient listings on the actual product before use.
